1. Introduction
These Terms of Use (“Terms”) govern your access to and use of the Osss Performance Journal mobile application (“App”) operated by Osss Performance Pty Ltd (“Osss”, “we”, or “us”). Please read these Terms carefully.
2. App Description
Osss is a Jiu Jitsu journaling tool that allows users to:
- Track training sessions, techniques, and competition data.
- Capture and store videos and images of Jiu Jitsu techniques and training rolls.
- Set goals and track progress.
- Access mental performance techniques.
- Connect with other users, share techniques (Premium feature).
- Access the technique marketplace to sell techniques (Premium feature, separate agreement).
3. User Conduct
By using Osss Jiu Jitsu Journal you agree to:
- Abide by all applicable laws.
- Use the App only for its intended purpose (Jiu Jitsu training).
- Refrain from uploading any inappropriate, offensive, or copyright-protected content. Inappropriate content includes content of a sexual nature, involving minors, or containing nudity.
- Respect other users and maintain a positive community environment.
Failure to comply may result in account termination.
4. Intellectual Property
Osss Performance Pty Ltd owns all intellectual property rights related to the App, including code, design, and content (excluding user-generated techniques). You retain ownership of your uploaded content but grant Osss a license to display and use it within the App.
5. Disclaimers & Limitation of Liability
- The App is provided “as is”. Osss makes no guarantees regarding its functionality or error-free operation.
- Osss is not liable for any damages arising from App use, including indirect or consequential damages.
- Osss is NOT a substitute for professional medical or Jiu Jitsu instruction. Consult qualified professionals as needed.
6. Data Privacy
Osss uses Google Analytics to improve the App experience. We take data security seriously. While training data is stored in MongoDB, personal information is stored securely using AWS Cognito. In the unlikely event of a data breach, users will be notified via email immediately.
7. In-App Purchases & Subscriptions
Osss offers in-app subscriptions. Purchases made through the App are governed by the respective app store’s (Apple App Store, Google Play Store) policies. Subscriptions must be managed and cancelled through the platform where they were purchased. To cancel or modify a subscription:
- Apple App Store: Access your Apple ID settings, tap “Subscriptions”, and manage from there.
- Google Play Store: Open the Play Store app, go to “Subscriptions”, and manage from there.
8. Dispute Resolution
Disputes between Osss and users shall first be addressed through informal negotiation. If unresolved, a mutually agreed-upon mediator will be utilized.
9. Governing Law & Updates
These Terms are governed by the laws of Queensland. We may update the Terms periodically and will notify users via email.
10. Termination
Osss reserves the right to terminate any account violating these Terms or engaging in illegal activity.
